IS CHAPTER 7 RIGHT FOR ME?

Chapter 7, sometimes referred to as a “full” or “complete” bankruptcy”, is usually appropriate for eligible debtors whose assets are exempt and who do not have recent delinquent taxes, or mortgage arrears.  Generally, in Chapter 7, you wipe out what you can and deal with any debt that was non-dischargeable.

Chapter 7 is not appropriate if you received a discharge in a prior Chapter 7 case filed within the last 8 yeas or a prior Chapter 13 case filed within the last 6 years.

Chapter 7 is generally not for people whose equity in their home exceeds their homestead exemption.

 

If you have a home mortgage or car loan, you should also consider filling Chapter 13.
