It is very difficult to discharge student loans in bankruptcy. But it is not impossible. A debtor needs to file a lawsuit, and show that paying back the student loans would impose an “undue hardship.” These lawsuits are difficult and expensive. But if the case is strong enough, a good law firm can prevail.
