Discharging Student Loans

It is very difficult to discharge student loans in bankruptcy. But it is not impossible. A debtor needs to file a lawsuit, and show that paying back the student loans would impose an “undue hardship.” These lawsuits are difficult and expensive. But if the case is strong enough, a good law firm can prevail.

At Fuller Law Firm, we are prepared to represent debtors facing student loan problems. In 2017, our law firm filed a lawsuit against multiple student loan creditors, asking the court to discharge our client’s student loan debts. The student loan creditors filed a motion to dismiss. Our law firm fought the motion to dismiss, and we won.

Here is a copy of the court's opinion. Our client's confidential information has been removed.
