How California Wage Garnishment Rules Affect Your Paycheck

An Earnings Withholding Order is the legal instruction requiring an employer to deduct money from an employee’s pay. California Courts states that an ordinary garnishment may take up to 20% of wages, although the amount depends on income, applicable deductions, and other withholding priorities.

A Claim of Exemption asks the court to stop or reduce the withholding because it interferes with payment of basic needs. The request generally requires exemption and financial-statement forms documenting income, household expenses, and financial obligations. A judgment creditor, the party enforcing the judgment, may oppose the claim and request a hearing.

Important details to review include:

  • The type of debt: Consumer judgments, child support, spousal support, taxes, and federal student loans are subject to different collection rules.
  • The source of the money: Social Security, retirement income, and other funds may have protections that don’t apply to ordinary wages.
  • The withholding documents: The order, employer notice, court papers, and any hearing date can identify who is collecting and what action is underway.
  • The household budget: Pay stubs, necessary expenses, and dependent information may be relevant to an exemption request or broader debt review.

How Bankruptcy May Address Paycheck Withholding

Filing a bankruptcy petition generally triggers an automatic stay, a federal protection that pauses many collection actions involving debts incurred before filing. It may apply to enforcement of qualifying judgments, but it isn’t unconditional. Previous filings, later court orders, domestic support obligations, certain tax matters, and other statutory exceptions can affect its scope.
